Key Underwriting/Qualifying Factors (including but not limited to):
- Both the "work" and "job location" are specifically designated on the policy.
- If your client is planning on working near or around a railway, a contract is required by the railroad due to the easements that are involved.
- The contract has an indemnification requirement that cannot be satisfied by the Commercial General Liability Policy if the operations are within 50 feet of railroad property.
- The Railroad Protective Liability Policy is the only method provided to satisfy the indemnification requirements in a contract between a railroad and a contractor when operations are within 50 feet of railroad property and involves construction or demolition.
- This coverage is specific to job and location and ends with the completion of the jobs.
- The named insured on these policies is the railroad company (property owner).
- The application will typically come from the contractor performing the construction as required by their contract with either the railroad or municipality where the work is located.
- The contractor is usually responsible for the premium.
